GENERAL CONTRACT TERMS (G.C.T)

1. Contract subject
Occupation of the properties (flats-holiday houses known with a reference name in the up-dated web site) according to the conditions specified below.
Golfoonline which offers a touristic service exclusively as mandatary of other parties (owners of habitable properties) has chosen the properties and reported logistically and with photos, their location. Also referring to the reacheability, its services and (the) its main features in the web site.
Golfoonline’s customers will be able to require further information or explanation on particular topics (for instance newborn furnishings and furniture, specific arrangements for handicapped people, no admittance to pets etc.) till the booking date. Booking implies

2) Signing the contract, payment /settlement of the expenses concerning booking service and deposit.
The booking format is unconditioned better if reservation is made following the online instructions.
Golfoonline will send to the email address requested by the customers, confirmation of booking which will decreet the execution of the contract in all its sections.
Within 3 days from confirmation, the customers will have to pay a deposit amounting to 30% of the price arranged / for the period booked. In case that the expiry date falls on holidays or pre holidays, the date in time to settle the payment will be postponed to the following week day.
The customers will have option to choose how to settle the payment as shown in the booking file/form considering that the payment is not settled by credit card. The proof which confirms the remittance has to be sent to Golfoonline also by fax or email according to the conditions expressed/reported in the contract (see above).

3) Immediate booking cancellation
Booking will be immediately cancelled and without notice if, three days from booking, have passed the settlement of the deposit does not reach Golfoonline.

4) Payment of the booking settlement
The settlement of the total of the booking fee will have to reach g. 39 days before the arrival according to the same formalities expressed in head no 2. In case that booking should be made in shorter time the settlement of the full amount will have to reach g. within 10 days or at the time of confirmation. In any case the prepayment of the total sum along with the cautional deposit will have to be settled before the delivery of the house keys.

5) Cautional deposit and key delivery
Before delivering the house keys, the customers will have to pay a cautional deposit of € 200,00 to g. which will give it back (to the customers) on the day of departure after checking the condition of the property and its contents. They will have to be in conformity to the conditions on arrival in default. Golfonline will deduct from the cautional deposit what is necessary to restore the property its accessories and contents registered in the stock except identification.

6) Number of tenants occupying the property
The maximum number of tenants occupying the property refers to the number established in the file. In case of a higher number of tenants, Golfoonline will have to be informed/ to receive prompt information, on booking time. If the request is accepted g. will consider and credit a higher price on the basis of the prices shown in the price list/tariff.

7) Prices/tariff
The tariff related to the stay spent in each property can be consulted in the web site. The prices will refer to booking, confirmation along with debit expenses concerning extra additional services.
The prices concern the holiday period which is of one week. They include the following expenses:
Electricity, water, gas, bed linen change, bed linen, cleaning during the customers stay and final cleaning. They do not include the following extra expenses: methane gas, conditioning air in the summer time, stay taxes, cautional deposit.

8) Holiday/stay period
Any stay period will have to be communicated from booking and confirmation time the holiday periods refer to weeks and divided in: high peak, hid peak, low peak.

9) Local services
Golfoonline gives detailed information gathered and up dated on local services, transport, events. It will not be responsible for their possible changes, interruption or also for bad weather conditions, natural disaster, incidental public order accidents, earthquakes, riots or other possible accidents caused by third party.

10) Arrival and departure
Except agreement to the contrary
Arrival and departure day: Saturday
Arrival time: from 16:00 p.m. to 20:00 p.m. upon telephone notice by which it will be possible to arrange the meeting place, the precise time of arrival or any other alternative time of arrival.
Departure time: within 10:00 a.m. upon telephone warning in order to arrange the exact departure time or any other one. Refunds for postponed or tenantless properties or anticipated departure will not be given. On arrival before delivering the house keys a € 200,00 caution will have to be paid.
It will also be made a check on gas consumption and its amount in case of use of the central heating the caution will have to be signed by both parties. The customers will have the right to complain of any objection concerning their tenancy of the property up to 30 days from departure after 30 days the customers will lose the right to make any further objection.

11) Booking cancellation
The customers will be able to cancel booking in that case: if cancellation is conveyed/communicated 40 days before arrival Golfoonline will withhold the deposit paid; if cancellation is conveyed 30 days before arrival Golfoonline will withhold 50% of the amount paid; the remaining amount, net of expenses, will be sent to the customers address within 30 days from communication of cancellation; If cancellation is communicated 10 days before arrival, Golfoonline will withhold 80% of the amount paid: the remaining amount will be sent to the customers address within 30 days from communication of cancellation net of expenses; if cancellation is conveyed 9 days before arrival g. Will withhold 100% of the amount paid.

12) Replacement of the property booked
Go reserves a right to replace the property booked with others resembling it case of serious unforeseen events that are not within the company control. In case of force majeure (natural disaster, wars, riots, destruction, serious damages of the property booked) the tenancy is cancelled and go will pay back the amount paid, net of booking expenses.

13) Applicable law, forum, legal department
According to what is not foreseen in the current contract, on decrease the laws/regulations, the rules of the Italian republic, its habits and local customs that the customers, on conclusion of the contract, declares to accept, are valid (on decrease). Further arguments that would arise in any time about the validity, the vision or the application of the current contract will be remitted and the customers will personally renounce the non-contentious jurisdiction, the arbitrator’s decision according to the regulations of the arbitration board appointed at the chamber of commerce, industry, agriculture, craftsmanship of La Spezia.
The parties will wholly accept the conditions above.
The arbitrator will decide in conformity with the law/and comply with the laws of de code of civil procedure related to the arbitration during the proceedings the arbitration office will be at the arbitration board itself.
The arbitration proceedings expenses will be conformed to the party who loses a case or be equally shared by the arbitrator.

14) Contract terms modification
Any modification revision or supplement to the current contract will be possible only upon agreement of the parties. It will have to be reported and put into writing otherwise it will tot be accepted.

15) Observance of public order regulations
The customers commit themselves to behave well according to the public order regulations and public safe too, in particular to the rules concerning the sole text of public safe of law 269/98.
The customers commit themselves to relieve on purpose g. And the property owner of all responsability.

16) Informative paper regarding law 31.12.6 n.675 (In defence of people’s privacy)
Go provides for the inclusion of part of the customers personal data, employed by Golfoonline in order to manage the purchase of services. Golfoonline would like to inform the customers that the data gathered will be used according to law 675/96 (defence of people and other parties in accordance to the use on personal information) and will be processed by means of machinery (manual or automatic) suitable to guarantee safe and discretion.
The data gathered will be communicated to people whom the transfer of data, necessary, functional and relevant to the management of the services/offered and they will not be given out by g. Apart from particular cases in which it is foreseen by the law on purpose. According to the aforesaid conditions the rights referring to article no 13 law 675/96 could be exercised.

Specific approval
According to articles n°1341/1342 of civil code, the customers after carefully looking over the contract declare to accept and approve specifically and separately, the clauses marked with numbers 1 to 17.
